2.1 Introduction
These Finder App Terms ("App Terms") govern the Finder App when installed on your device and used or otherwise interacted with by you (including your device). The Finder App is designed and owned by Finder Ventures. The Finder App is operated by Finder.
Within the Finder App, you can access and use the Services provided by Finder and the Finder Affiliates (such as Finder Ventures and Finder Wallet).
Finder and the Finder Affiliates may be referred to as "we", "us" or "our" in the App Terms . Together, you and we may be collectively referred to as "Parties".
The App Terms form part of, and are incorporated by reference into, the Terms of Service.
Unless otherwise expressly defined in the App Terms, capitalised words and phrases used in the App Terms have the meaning given in the Terms of Service.
2.2 Additional Terms and Policies
2.2.1 Terms of Service and Privacy Policy
By using the Finder App, you're trusting us with your information. We understand this is a great responsibility and it's important for you to understand what information we collect and why we collect it. Please understand that by using the Finder App you are confirming that you have read and understood both theFinder Group Privacy Policy and Terms of Service.
2.2.2 Service Terms
The App Terms are supplemented by the applicable terms of each Service, to the extent that you use or otherwise interact with the relevant Service via the Finder App:

2.3 How Does Finder Use My Data?
Based on your interactions with the Finder App and, where you have opted-in to the Credit Score Service, we will find personalised ways to save and help you make the most of your money and will send this information to you via the Finder App and/or email.
2.4 Who Can Access My Data?
As long as you have biometric or PIN authentication enabled, no one but you can access your data through the Finder App. Authorised Finder employees have restricted and audited access to our systems for engineering and troubleshooting purposes only. We do not sell your information.
2.5 How Can I Opt Out Of My Data Being Used?
You can contact us at any time to opt out and request that we stop processing your data. Please refer to the Finder Group Privacy Policy for more information on how to exercise your rights.
2.6 Acceptable Use Policy
You may not use the Finder App or the Services available within the Finder App to engage in conduct that, in our opinion:
- is unlawful;
- is defamatory, harassing or threatening to any person;
- promotes or encourages physical or mental harm of any person;
- promotes violence against and person; or
- threatens or promotes terrorism.
In the event that you fail to comply with our Acceptable Use policy as detailed above, we may without notice and immediately or at any time:
- refuse to process or complete any transaction or dealing of yours; and/or
- suspend or discontinue your access to the Finder App or any Services available within the Finder App.
2.7 Using Touch ID (Fingerprint Logon - iPhone 5S or Newer Models)
If you have the Finder App installed on an iPhone that has Touch ID available, you will be able to turn on Touch ID access for the Finder App. Turning on Touch ID for the Finder App means that you can access the app using your fingerprint instead of your PIN or password. For certain transactions on the Finder App, you may be prompted to enter your PIN or password as an additional security measure.
You must not turn on Touch ID access for the Finder App if you have any fingerprints stored on your device other than your own, if, after turning on Touch ID, you allow other people to use their fingerprints on your device, you must first turn off Touch ID access for the Finder App.
If you do allow anyone else's fingerprints to be stored on your device (despite this being against the App Terms): (i) they will be able to access your Finder Account and considered authorised to do so; and (ii) you will be responsible for their transactions.
Touch ID access for the Finder App can only be turned on if it is available on your iPhone model and has been enabled by you on your device. Touch ID is technology provided by Apple and accordingly we are not responsible: (i) for any malfunction in Touch ID; and (ii) if Apple makes any changes to its Touch ID technology that impacts the way you access the Finder App.
You will still be able to access the Finder App using your PIN or password.
If you choose to use Touch ID access for the Finder App, you will still need your PIN and must set and protect your PIN in the manner outlined in the App Terms.
2.8 Using Face ID (iPhone X or Newer Models)
If you have the Finder App installed on an iPhone that has Face ID available, you will be able to turn on Face ID access for the Finder App. Turning on Face ID for the Finder App means that you can access the Finder App using facial recognition instead of your PIN or password. For certain transactions, you may be prompted to enter your PIN or password as an additional security measure.
You must not turn on Face ID access for the Finder App if the Face ID stored on your phone is not your own. If, after turning on Face ID, you allow other people to store their Face ID on your device, you must first turn off Face ID access for the Finder App.
If you do allow anyone else's Face ID to be stored on your device (despite this being against the App Terms): (i) they will be able to access your Finder Account and considered authorised to do so; and (ii) you will be responsible for their transactions.
Face ID access for the Finder App can only be turned on if it is available on your iPhone model and has been enabled by you on your device. Face ID is technology provided by Apple and accordingly we are not responsible: (i) for any malfunction in Face ID; and (ii) if Apple makes any changes to its Face ID technology that impacts the way you access the Finder App.
You will still be able to access the Finder App using your PIN or password.
2.9 Protecting Against Unauthorised Transactions
2.9.1 Finder App Access PIN
When you register for the Finder App, you have the option to set up a Finder App access PIN. You can change this PIN after logging into the Finder App.
2.9.2 Protecting Your Finder App Access PIN
You should always:
- memorise the PIN as soon as possible - if you record it, disguise it so others can't decipher it;
- if you nominate a PIN, use a number that is not obvious or can't be easily guessed (e.g. don't use date of birth or driver's licence number); and
- take precautions when using the Finder App (e.g. don't let anyone watch you enter your PIN).
You must never:
- tell or let anyone find out your PIN - not even family or friends;
- record a PIN on your device or computer; and
- keep a record of the PIN with your device.
2.9.3 Other Security Obligations
- Lock your mobile device and take any reasonable steps to stop unauthorised use of the Finder App;
- If your mobile device is lost or stolen, notify us immediately;
- If you suspect your Finder App access PIN has become known to someone else, notify us immediately; and
- Only install approved applications on your mobile device and never override the software lockdown (i.e. jailbreak your mobile device).
2.9.4 Other Prohibited Conduct
- Allow another person to use your device to access any of the Services available through the Finder App;
- Leave your mobile device unattended; and
- Use the Finder App with a device other than a compatible mobile device.
2.10 Other Things You Should Know
2.10.1 Email Verification
- For security reasons, each time you register for the Finder App, you are prompted to verify your email address; and
- After verifying once, you won't have to do so again on the same device until you need to re-register.
2.10.2 Check Your Details Carefully
- Please take care to enter the correct details or your transactions may be unsuccessful and/or you may not be able to recover transaction amounts. We do not check that the details that you provide are correct; and
- You cannot delete or cancel a Finder App transaction once it has been made.
2.10.3 Fees
Fees and Charges are published on the Finder App. We may change our fFees and Charges from time to time. We may notify you of any changes to our Fees and Charges by publishing notice of such changes on the Finder App. You should review the current Fees and Charges prior to accessing the Online Platform or using the Services. You may incur charges from your mobile service provider for downloading and using the Finder App.
2.10.4 Location Data
If you grant the Finder App permission to use your device's location information, we will log this information for security purposes and to enable other Finder App functionality where location information is required. This information is used to enable us to continually improve our Services. Please refer to the Finder Group Privacy Policy for more information.
2.10.5 Suspension or Termination
Despite any rights contained in the App Terms:
As part of our Anti-Money Laundering Program ("AML Program"), we will monitor your Finder Account and your use of the Finder App, and review your personal information on an ongoing basis, as may be required by law or pursuant to our internal policies and procedures. At any time, we may require you to provide us with additional personal information as a condition to your continued access to and use of your Finder Account and the Finder App. During such time, we may immediately refuse to process or complete any transaction or dealing of yours, and suspend or terminate the provision of the Finder App to you.
We can also suspend or terminate access to the Finder App or not process a transaction without notice if:
- we think you are using the Finder App in connection with unlawful means including fraudulent or in a way that might cause you or us to lose money;
- we consider to do so is reasonably necessary, for example, to comply with laws in Australia or overseas or manage regulatory risk.
To manage our compliance with international laws and our financial and regulatory risk, we can also suspend or terminate the provision of the Finder App to you while you are within sanctioned countries.
We may also at our discretion suspend or terminate the provision of the Finder App. When we exercise this discretion, we will act fairly and reasonably towards you in a consistent and ethical manner. In doing so, we will consider your conduct, our conduct and the accounts, and/or Services which are being used (or attempted to be used).
If we exercise our rights under this clause, we will be under no liability to you and you must pay any of our losses, costs or expenses that will incur in relation to any action taken under this clause.
2.10.6 Changes to the Finder App Terms
We may change the App Terms at any time. We will notify you of any material changes by electronic notice to you via your device or the App Store. We may require you to confirm your acceptance of changes to continue using the Finder App.
2.10.7 Product Information
You may be able to access information about our or our partner's products and services via the Finder App. You acknowledge that it is your responsibility to assess the appropriateness of any product or service in light of your personal objectives, financial situations or needs, and, if necessary, seek appropriate professional advice. The provision of product information is not and should not be seen as the provision of personal financial advice.
2.10.8 Acknowledgement and Compliance
The Finder App is not provided by Apple or any other third party provider. Accordingly, any queries or complaints regarding the app (including but not limited to issues regarding intellectual property) should be directed to us and not Apple. The foregoing applies for the benefit of Apple. You also acknowledge the application of Australian anti-money laundering and counter terrorism financing regulations, and agree that you are not in a location that is subject to a government embargo.
2.10.9 Collecting Device and Network Information
You acknowledge and agree that we will collect information about your device and network connectivity for security purposes, including:
- Device characteristics and unique identifiers;
- Cellular and WiFi network names and encryption levels; and
- IP addresses.
2.11 Notifications
We may send notifications via a push notification service or other reminder mechanism or via SMS. Push notifications will be sent to any compatible device on which you have installed and registered the Finder App with push notifications enabled, and confirmed your mobile number.
Depending on your phone settings, notifications may be seen by other people (including unauthorised persons) who are able to see your phone. Please check the notification settings on all your devices to ensure the privacy and notifications settings are appropriate for your use.
Alerts may include:
- Security and service alerts;
- Alerts when new versions or upgrades are available; and
- Special offers, information and reminders about products and services.
You agree to receive notifications and acknowledge that their delivery may be subject to the quality of your connection. It is your responsibility to check any notification information before acting on it. All notifications will be sent to you and managed in accordance with the Finder Group Privacy Policy. We reserve the right to suspend or discontinue notifications at any time without notice. Notifications that do not affect your obligations to comply with the terms applicable to the products and services you use via the Finder App.
As part of the Finder App, we may from time to time send you messages, e.g. through push notifications or within the notifications section inside the Finder App, including commercial electronic messages advertising, promoting or offering new or existing products, services or messages. You agree to receive such messages and that commercial electronic messages need not contain information about how to unsubscribe.
